The ACCC Debt Collection Guidelines and the Privacy Act

Overview

This part of the workshop provides all participants with awareness
of the current guidelines and Privacy Act.

Workshop Objective

- What the potential fines may be
- What you can and can't say
- Who you can discuss the account with
- Defines what constitutes harassment

The Outcomes

- How to collect within the guidelines and the privacy act
- How to deal with the customers within the guidelines and the
  Privacy Act
- How to stay safe

The Legal System in Relation to Debt Collection

Overview

This workshop provides participants with a basic knowledge of how
the legal system works in relation to debt collection.

Workshop Objectives

- Provide a practical understanding of the legal process in recovering
  overdue debts.
- Understanding the terminology
- What you can and cannot do in relation to the collection of overdue
  accounts through the legal system
- The time lines that are involved
- What enforcement options are available to recover debts

The Outcomes

- Understanding the current legislation in relation to the credit
  industry
- Enable the participants to advise the debtors of the consequences
  of non payment of the account
- To help the participants in deciding what course of action should be
  taken.

Bankruptcy and Insolvency

Overview

This is a half-day workshop that is designed for the participants to
Understand the different types of Corporate Insolvency and
Bankruptcy

Workshop Objectives

- Provide a detailed description of Corporate Insolvency
- Provide a detailed description of the different types of Bankruptcy
- Provide a detailed description of Administration and Receivership
- Understanding what are preferential payments are and you rights
- What you can do if your debtor is trading whilst insolvent

The Outcomes

- Have more confidence when dealing with liquidators and/or
  receivers
- Participants will have the ability to discuss the consequences of
  insolvency with potential bad debtors
